SLICE™ Warranty
END USER LIMITED WARRANTY STATEMENT
SECTION 1 - What is covered by this limited warranty?
Making Memories Wholesale, Inc. ("Making Memories") warrants to the first retail purchaser that the SLICE™ Electronic Cutter System covered by this limited warranty statement (the "Product"), if purchased and used in the United States, will conform to the manufacturer's specifications as set forth in the accompanying documentation and will be free from material defects for the following periods of time (each a "Warranty Period" and collectively the "Warranty Periods"):- Except as set forth in Section 2, twelve (12) months from the date of original purchase for all electronic parts, including motors, wiring, switches, LCD screens and other electronic components.
- Except as set forth in Section 2, ninety (90) days from the date of original purchase for all non-electronic components.
- Except as set forth in Section 2, ninety (90) days from the date of original purchase for all SLICE™ branded content cartridges.
- Except as set forth in Section 2, ninety (90) days from the date of original purchase for all labor.
SECTION 2 - What is not covered by this limited warranty?
This warranty covers only normal use of the Product in the United States and does not cover the following:- Damage to the Product caused by parts or supplies not manufactured, distributed or certified by Making Memories.
- Third party parts, components or peripheral devices added to the Product after its shipment from Making Memories.
- Products that have the Making Memories label or logo, or serial number removed or altered.
- Failure of the product to function properly as a result of accident, misuse, abuse, non-Making Memories modification, use in an unsuitable physical or operating environment, improper maintenance by you, improper storage, neglect, improper shipping, damage caused by disasters such as fire, flood, lightening, improper electrical current, interaction with non-Making Memories products, or service by someone other than Making Memories.
- Damage to the product following use in a business or for commercial purposes.
- The cutting blade housing, cutting blade changing tools and cutting blades, whether supplied with the product or sold separately from the Product.
- The cutting mats, whether supplied with the Product or sold separately from the Product.
SECTION 3 - Does Making Memories offer technical support for the Product?
If you believe that the Product is not working properly, please go online to www.whyslice.com. There, Making Memories has provided videos, common Questions & Answers, and other information regarding the Product, including tips to help you diagnose and troubleshoot problems with the Product. If you believe that your Product is not working properly after reviewing and applying the content provided at www.whyslice.com, please contact Making Memories Customer Care as set forth in Section 4.SECTION 4 - What do I do if I need warranty service?
To obtain warranty service during the Warranty Period, contact Making Memories Customer Care at 1-800-286-5263. Customer Care will ask you to provide information, including your name, address, phone number, place and date of purchase and a brief description of the problem. Customer Care will then attempt to diagnose and trouble shoot the problem with you over the phone. If Customer Care determines that the Product is defective and the problem cannot be resolved over the phone, then Making Memories will, in its sole discretion, do one of the following:1) Send Replacement Parts. In the event that Customer Care determines that certain parts or components are defective, Making Memories may send you replacement parts or components (the "Replacement Parts") and instructions for installing those Replacement Parts. You will be responsible for installing the Replacement Parts. Making Memories may require you to return the defective parts or components, in which case it will provide you with instructions and a shipping box. Making Memories reserves the right to charge you for any Replacement Parts if it does not receive the defective parts or components within thirty (30) days after your receipt of the Replacement Parts.
2) Repair or Replacement of the Product. In the event that Making Memories Customer Care determines that the Product you purchased is defective, you must return the Product to Making Memories and Making Memories will either repair the Product or replace it with a new or a rebuilt Product that is at least functionally equivalent to the Product that you purchased. In the event that Customer Care determines that it will repair or replace the Product, Customer Care will issue you a return authorization code, which must be clearly and prominently placed on the outside of the shipping box that you use to send the Product to Making Memories. Along with the returned Product, you must include the following inside the shipping box: your name, address and phone number, place and date of purchase, the return authorization code, brief description of the problem and proof of original purchase (e.g., invoice or sales receipt). As you are responsible for the costs of both shipping and insuring the Product, you should insure the return shipment for the full purchase price of the Product.
Alternatively, in some circumstances, Customer Care may send you return shipping materials and instructions for return of the Product. Upon receipt of the return shipping materials, you must follow the enclosed instructions for packing and returning the Product, including providing Making Memories with your name, address and phone number, place and date of purchase, a brief description of the problem and proof of original purchase. You should insure the return shipment for the full purchase price of the Product
If the Product is no longer within the Warranty Period, you must pay for all labor and parts charges.
SECTION 5 - May I transfer the limited warranty?
This warranty is not transferable and will not apply to Products purchased from an end user.SECTION 6 - DISCLAIMERS AND LIMITATION OF LIABILITY
Your sole remedy under this limited warranty statement shall be the warranty service. Making Memories' liability for damages to you for any cause whatsoever arising out of or related to this limited warrant statement or any other claim related to the Product shall be limited to the amount that you paid for the Product at the time of original purchase.EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY STATEMENT, THE PRODUCT IS PROVIDED TO YOU ON AN "AS IS" BASIS AND MAKING MEMORIES MAKES NO OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE PRODUCT. ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED AND EXCLUDED. MAKING MEMORIES DOES NOT WARRANT THAT THE PRODUCT IS ERROR-FREE OR THAT IT WILL MEET YOUR REQUIREMENTS. NO EMPLOYEE, AUTHORIZED RESELLER, UNAUTHORIZED RESELLER, AGENT OR REPRESENTATIVE OF MAKING MEMORIES HAS AUTHORITY TO BIND MAKING MEMORIES TO ANY ADDITIONAL REPRESENTATION OR WARRANTY CONCERNING THE PRODUCT AND, UNLESS STATED HEREIN, ANY STATEMENTS OR REPRESENTATIONS MADE BY ANY OTHER PERSON OR FIRM ARE VOID. SOME LAWS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF THESE LAWS APPLY, THEN ALL EXPRESS AND IMPLIED WARRANTIES ARE LIMITED TO THE WARRANTY PERIOD IDENTIFIED ABOVE.
EXCEPT AS PROVIDED IN THIS WRITTEN WARRANTY, NEITHER MAKING MEMORIES NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY LOSS, INCONVENIENCE, OR DAMAGE, INCLUDING DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR INABILITY TO USE THE PRODUCT, WHETHER RESULTING FROM BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY, EVEN IF 1) MAKING MEMORIES, 2) A MAKING MEMORIES AUTHORIZED RESELLER, OR 3) ANY OTHER RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, AND SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MY HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.
